2006 Stallion Breeding Contract
for Cooled Transported Semen

  

This Agreement entered into this _____ day of _________, 20__, is by and between Laura Jo West dba Signature West Paint Horses hereinafter referred to as “Breeder” and ____________________________, hereinafter referred to as “Mare Owner.”  Mare Owner agrees to breed the mare ____________________,

Registration #_______________, to the stallion Autograph, # 238966, for the fee of $850, for a live foal, subject to the following conditions: 

 

  1. The breeding fee includes a non-refundable booking fee of $250, payable upon execution of this contract.  All specified fees must be paid when the mare owner is invoiced or prior to first shipment, whichever comes first.  Invoices are payable upon receipt.  Balances remaining 30 days after invoice will be subject to finance charges at the rate of 2.0% monthly. 

 

  1. Mare Owner will be assessed $180 for each subsequent shipment ($90 collection and processing fee and $90 shipping/courier fee).  Semen will not be shipped until payment is received.  International shipments will be shipped at cost plus a $25 courier fee.

 

  1. Mare Owner must provide a $275 refundable deposit for the use of the Hamilton-Thorne Equitainer.  All fees, including the booking fee, the balance of the breed fee, the $90 fee for first shipment, and the Equitainer deposit must be paid prior to the first shipment.

 

  1. Shipments will be made using UPS Next Day Air or Federal Express Priority Overnight.  Please note: due to the remoteness of our farm, Breeder cannot provide counter-to-counter same day delivery.  Mare Owner understands that semen delivery on Sunday or Monday via Federal Express or UPS is not possible. 

 

  1. Mare Owners opting to pick up semen at the farm will not be charged for the first collection per the terms of this contract.  A $90 collection and processing fee will be charged for each subsequent collection.

 

  1. Mare Owners opting to bring their mare to the farm for breeding only (no boarding) will not be charged for the first collection per the terms of this contract. A $90 collection and processing fee will be charged for each subsequent collection.  In addition, a fee of $25 will be charged per insemination.

 

  1. Equitainers must be returned by the Mare Owner and received intact and in good condition by the Breeder within 5 (five) days of shipment.  This may require an overnight shipment to make sure the container is returned in a timely manner.  A late charge of $25 per day will be assessed after 5 days.  Mare Owners are responsible for the cost of returning the Equitainer to the Breeder.  The cost of damages to the Equitainer or its contents will be deducted from the container deposit.

 

  1. Semen will be collected on an as-needed basis between February 15 and June 15, 2006.  Breeder agrees to diligently attempt to provide semen when requested.  Mare Owner understands that the Breeder cannot guarantee that semen will be available on any given day.  Breeder assumes responsibility to ship enough extended semen (in viable condition at the time of collection) to provide a minimum of 500 million progressively motile sperm to the Mare Owner.  Breeder is not responsible for the untimely delivery or condition of cooled transported semen or semen that is mishandled in any way after leaving the breeding farm.  Breeder also shall not be held responsible for shipments lost, damaged, or delayed in transit.

 

  1. Mare Owner understands that it is vital to keep Breeder informed as to the breeding status of the mare and agrees to the following:
    1. notify Breeder one week prior to the start of mare’s cycle
    2. notify Breeder the day the mare enters estrus
    3. alert Breeder the evening prior to needing a shipment
    4. call Breeder before 9:00 a.m. MST to verify or cancel that day’s shipment

 

  1. Mare Owner agrees to have a qualified veterinarian or breeding technician inseminate the mare. 

 

  1. Mare Owner agrees to sign and return the paperwork included in each shipment to Breeder and to APHA as instructed. Mare Owner assumes responsibility for association documents, registration fees, and DNA typing needed for mare and/or resulting foal.

 

  1. This contract includes a live foal guarantee.  A live foal is described as a newborn foal that stands and nurses without assistance.  If foal is born dead, there are return privileges for the following season only if Breeder is notified within ten days by a licensed veterinarian that the mare has slipped or produced a nonviable foal.  If after being pronounced “safe-in-foal” the mare should miscarry, abort, or prove barren, Mare Owner may re-breed her during the current breeding season (February 15 – June 15) or during the 2007 breeding season only.

 

13. This contract contains a color guarantee.  If the resulting foal cannot be registered in the regular registry of the American Paint Horse Association, Mare Owner has the option of rebreeding the same mare, or a substitute mare approved by the Breeder, at a reduced rate the following breeding season only.  Mare owners choosing to rebreed on a color guarantee will be charged an amount equivalent to ˝ the 2006 breed fee (i.e a non-refundable $150 booking fee plus an additional $275 breed fee).

 

  1. All second season rebreeds (regardless of reason) under this contract will require payment of a $150 non-refundable booking fee.  A charge of $180 per shipment will apply to each shipment during the second season.  All payments must be received prior to shipment.  Mare owners either picking up semen at the farm or bringing their mare to the farm for insemination will be charged the $90 collection fee per collection.

 

  1. In the event of the death or incapacity of the mare, Mare Owner has the opportunity to breed a substitute mare to the stallion, provided that the Breeder has given advance approval in writing of the proposed substitute mare.  No refunds shall be made.  In the event of the stallion’s death or unfitness for breeding during the current breeding season, the breed fee, minus the non-refundable booking fee, will be refunded.

 

  1. A Breeder’s Certificate will be issued to Mare Owner after all expenses have been paid in full and upon notification of the birth of the foal.

 

  1. All terms of this contract/addendum, including terms of second season rebreeds, are non-transferable.
